Four hours later it popped up on our news, I couldn't believe it. And then the images that I seen online. I can't even believe that stuff was online.

Speaker 2:

That's horrible, but that's another story for another episode. Today's episode is part two of In the.

Speaker 2:

Crosshairs. We're going to bring you back up to speed on the story, since we've had two special episodes in between part one and part two. On July 18th 2022, dan Markell was murdered as he was pulling into his garage by two hitmen named Luis Riviera and Sigfrido Garcia. Also arrested was Charlie Adelson, 38 at the time of the murder, and Katie McBanwa, 29 at the time of the murder, and Donald Adelson, which was Charlie and Wendy's mother. Wendy is the ex-wife of Dan Markle, which, if you listen to episode one, they were going through a pretty rigorous divorce at the time of the murder.

Speaker 1:

Garcia is connected to Katie and Katie is connected to Charlie Adelson, so Charlie is Wendy's little brother and he owned half of the Adel Institute. He was also a periodontist and he met Katie in the summer of 2013 when they worked at a dental office together. Katie in the summer of 2013 when they worked at a dental office together, and then they started dating in the fall of 2013.

Speaker 2:

Now keep in mind that Katie and Charlie were only in a relationship for less than a year when all this happened. That's going to be kind of important and kind of shocking too, as we start to unfold the story. So the way they started tying all these suspects together was the contacts on their phones. So, Riviera and Garcia they were tied to the vehicle seen leaving the murder. They started looking at their top contacts and one of Charlie's top contacts and one of Garcia's top contacts was Katie McBanawa.

Speaker 1:

And eventually the police wiretapped the Adelson's and Katie's phones, but no one was talking about what happened. So guess what they had to do.

Speaker 2:

They had to send in a decoy.

Speaker 1:

Yeah, so during the course of the investigation, it was decided to use an undercover agent to make contact with Donna in reference to Dan Markell's murder. The undercover agent provided a press release of Markell's murder and asked for $5,000. He provided a phone number at which he could be contacted. Now, as a result of this, contact conversations were intercepted.

Speaker 2:

To set the scene of the undercover sting. Donna walks out of the building of her condominium and headed a couple of blocks away to pick up her grandchildren. When she was approached by a somewhat large man, he had a shaved head, big black goatee and sunglasses. Kind of looked like a Mexican gang member, like an essay type of dude you know what I mean. He played the part good. I have to give him that Now we got audio of when the agent approaches. Donna, I want to play that for you real quick.

Speaker 1:

Excuse me, mrs Adelson. Hey, dylan, just want to give you this. Listen to you. You're scaring me, don't be scared, listen. I just want to let you know that we know that your family has been taking care of Katie and her friend, who died some time after your problem up north had to be solved. And I want to let you know that my brother, he's incarcerated. He helped your family with this problem you guys had up north and we want to make sure that he's going through some rough times. We want to make sure that you take care of what he's going through, the way you're taking care of Katie and Tudor.

She looks like she's about to pass out yeah, without trying to fall over, she's like shoot mean, it fucked her up pretty good, you can tell. She about passed out when the guy introduced himself, but he was super nice.

Speaker 2:

He was super nice about it. Now, keep in mind, charlie and Donna were basically only dealing with Katie, so they didn't really know Garcia and Rivera, so they didn't really know Garcia and Rivera. So in her mind she doesn't know if this is real or if this is the police messing with her or what. So out of this meeting, that's when shit starts to really unfold. It was genius for them to do that, really.

Speaker 1:

Yeah, because what do you think Donna is going to do? I?

Speaker 2:

bet she, just like the police thought she was going to do, immediately called Charlie.

Speaker 1:

Yeah, that's exactly what she did. Well, she finished walking down to get her grandchildren and then she got them, came back. As soon as she got back, boy, she called Charlie, asking him to meet her about some paperwork that was hand-delivered to her outside her condominium. During the conversation. When Charlie inquired whether it involved him or others, donna responded in a whisper Well, probably both of us. When Charlie asked her to repeat herself, she stated Probably the two of us, and you probably have a general idea of what I'm talking about. When Charlie inquired further, donna said that this was not something she wanted to discuss over the phone.

Speaker 2:

Donna and Charlie discussed meeting and whether or not Charlie needed to bring cash. Charlie inquired whether or not a threat was involved and whether the police should be contacted. Donna responded that this time she did not believe that was a good idea. Charlie Adelson immediately told his mother Donna Adelson, don't talk about things in the apartment or any place. He then asked if the person was black, white or Hispanic, to which Donna said he was white. If the person was black, white or Hispanic, to which Donna said he was white, charlie said sounds like something that needs the police. Donna said she may have to, but wants to talk to him first. When Charlie asked what the letter asked for, donna said this TV is probably about five. Charlie asked if they asked for $5,000, to which Donna responded affirmatively. Donna also said they mentioned an ex-girlfriend.

Speaker 1:

So Charlie gets off the phone with his mom and he calls Katie.

Speaker 2:

McBanawa.

Speaker 1:

So, after trying to reach her by phone unsuccessfully, he finally calls her back an hour after that and gets a hold of her, and he began to explain the situation to Katie as he understood it from his mother Something regarding her son, something regarding his ex-girlfriend and the person asking for some money.

Speaker 2:

Charlie tells Katie that he is going to see his mother the next day to discuss the matter. There is some discussion of whether Katie is the girlfriend referenced by the agent. Charlie said he thought his mother said the agent mentioned Katie's name, but is not sure, and will follow up with her if the situation does involve her. Katie agrees to meet Charlie in person the next day, and that's April 20th 2016 around 4 pm.

Speaker 1:

Another thing to note is Charlie never contacts any other females to discuss the contact between his mother and the undercover agent.

Speaker 2:

Now, on the, the morning of April 20, 2016, Charlie tells his mother he will meet her at her home at 12.35 pm. After Charlie arrived at the Icon and that's where Charlie's mother and father reside he and Donna walked outside to a remote table behind the building and sat close together while conversating. None of their conversation was successfully captured.

Speaker 1:

After meeting with Donna in person, he calls Katie and is en route to her sunny aisle real estate office where she works. When Charlie arrived at the strip mall where Katie works, they talk briefly outside. Then they go into a restaurant near the real estate office and parts of their conversation was captured while they sat in a restaurant called Dolce Vita.

Speaker 2:

See, at this point in the investigation, not only do they have wiretaps but they have people you know following their asses and spying on them and spying on him, and some of this conversation was recorded by somebody, one of the guys that was following him, and they went into the restaurant and was listening. They catch Charlie saying my mom doesn't know these guys and paying off someone is not an admission of guilt. Charlie kind of gives example question and answers that he wants Katie to say to the agent when she calls him, just to see what the guy knows, to see if it's the cops to fill them out, because they're trying to figure out who the fuck it is. They want to see what he knows about the crime, such as what kind of gun is used, what kind of car it was. Charlie's also saying you have to put that at the scene at the time, not in the car, and he's given examples of people being present in vehicles before cars are used in crimes, which is kind of weird.

Speaker 1:

And then Charlie says the guy's name is Tulo and he repeats this name to Katie. Now Charlie also tells Katie that the messenger looked white but could have been Hispanic. And then they were talking about. Charlie was referring to the rental car and he said I don't have any knowledge.

Speaker 2:

Charlie gives instructions to Katie saying I'll give you money. You call him on the phone. All I want you to say is I got a call from somebody who said you reached out. Then he tells her to say I got a call from friends that said you reached out to them and you mentioned my name. These people want to know if it's the police, which they had nothing to do with what you're talking about and frankly I don't. Either what you're talking about, but the name sounds familiar. Either what you're talking about, but the name sounds familiar, probably something as a charity to help the less fortunate. But do not contact these people again or they're going to call the police.

Speaker 1:

Charlie says to Katie you have to let him know that we had to do everything in the world to prevent these people from going to the police because they don't know anything and I don't know anything and that you to me sound a little familiar and that I will help you out with some charity. And don't ever contact me, my friends or my family again. We will that way. If he gets the money, if it happens again, we will go to the police.

Speaker 2:

So he's going to give Katie the money to give to this dude, but he also wants her to fill him out. And Charlie says if it's the police, they can't take the money and won't even come meet you. They fucked up. If it's this guy maybe that's what he knows you better kill him because he's going to have a big fucking problem. If you can't do it, I'll have someone else do it.

Speaker 1:

Charlie says he ain't going anyway. Problem is, if you and mom meet him to pay him, what happens next month when he needs help again? If it's the cops, she's guilty as hell.

Speaker 2:

After the in-person meeting with Katie, Charlie calls his mother back to report his meeting and says that he is handling everything. Donna then calls Charlie back, sounding very concerned.

Speaker 1:

On April 21, 2016,. Calls are intercepted between Katie and Charlie, and they attempt to disguise their conversation using real estate references such as security property posted incorrectly and wrong tenants for rental property. Charlie and his dad, Harvey, meet for dinner later this evening.

Speaker 2:

Katie and Garcia are intercepted having numerous arguments over the phone the morning of April 21st 2016,. It appears Katie is trying to convince Garcia to determine whose phone number it was from the undercover agent and or place to call himself and determine the identity of the person asking for financial assistance from Donna. In a heated exchange, garcia says I'm not making that fucking phone call. He later says I am going to take care of this fucking problem, so he's in jail at the time. Is he in jail at?

Speaker 1:

the time. No, no, he was there. They were living together and she comes home to him and was like you gotta make this phone call and figure out who these people are. She's like, he's like bitch, you're crazy.

Speaker 2:

I'm not calling these fucking people the cops send this agent in, he they're getting all their fucking feathers ruffled up. Charlie's freaking out. He thinks he's a gangster from LA when he's a Miami dentist. And Katie goes home to Garcia saying you got to figure out who the fuck this is. It either has to be the police or it has to be one of your SA buddies.

Speaker 2:

You know what I mean here call them yeah you call them or tell me whose number it is, try to figure it out. And he was like fuck you, I'm not fucking with, none of that shit, and I don't blame him.

Speaker 1:

Really, I'd be a nervous wreck if somebody come home and told me that shit so Approximately 20 minutes later.

Speaker 2:

The same morning, Katie called Garcia after she left the house. She told him she may have written down the number wrong or the amount for their son's school expense.

Speaker 1:

She thought it was $65.70, but it may be $60.57. Garcia is not following her intended message and she has to reiterate to him the amount that I gave you on the piece of paper. I don't know if it's 6057 or 6570. Garcia then responds got it. This is either their attempt to disguise the last four digits of the phone number provided for the undercover agent. It appears that Katie may have transposed the numbers from Charlie and she wants Garcia to either check for someone having that phone number or make the call himself.

Speaker 2:

Dude Garcia's probably sitting at home freaking stoned as hell and they're trying to beat gangster code on the phone. He's like what the fuck are you talking about? You know the number I wrote down for our school supplies 6057 or 60-something. You know what the fuck I'm talking about. He's like I don't know what you're talking about. I can only imagine man, they're all tripping and trying to do this code word shit. They didn't talk about it at first. You know what I mean.

Speaker 1:

Oh yeah, they continued to argue over the next two days. They were going at it. She was so pissed she packed up some of her belongings in her car and she left in the middle of the day on April 23rd. She tells Charlie that later in the day she had left the house and left the kids with their father, and then Charlie's like no, no, no, you can't do that. And he's trying to convince her to stay with Garcia and Katie's like fuck you, I'm not talking to you about this. And she tells Charlie to not respond if he gets any other phone calls about the property.

Speaker 2:

And keep in mind. The cops are listening to every phone call they make, because they're. They have each of their phones tapped and on April 23rd 2016, katie is intercepted telling a friend about the fight she had with Garcia, and she also told her friend that she took a pistol from her house and it's keeping her car, but she also lets the cat out of the bag that she doesn't have a permit to carry the gun. So the cops also know that at this point.

Speaker 2:

On Monday, the undercover agent sent a letter to Harvey and Donna's house. This letter was sent by regular mail by the investigators in purpose to follow up the mail, the piece of paper that he handed her in the undercover staying Calls were intercepted to indicate Donna had shared this information with Charlie, who, in turn, has forwarded the information to Katie. Mcbanawa has asked again for Garcia to call or check and see if you know he knew the number or who the number was, and he tells Katie oh, I've called it and it's not in service or it's not a good number. So either she's lying or either he's lying to Katie or Garcia is hasn't made no fucking phone calls. He's bullshitting her because the agent's phone number that they gave her was the right phone number and the cops double checked it, triple checked it and every time they called it it rang.

Speaker 1:

So somebody's lying somewhere in that aspect absolutely later that same day, charlie called katie and asked if she was on her way. It appears charlie and katie have been communicating through a different source to schedule a meeting. Charlie directs her to Harvey and Donald's building to meet. Charlie told Katie that he was talking to his parents about everything. Charlie continues to try and convince her to meet at Donna and Harvey's building, but eventually gives in and agrees to meet her at another location. Katie called Charlie back, who advised their meeting at a marina near Monty's.

Speaker 2:

On the 26th, Charlie calls Donna and they discuss the conversation that occurred the night prior. Donna said she feels better after their conversation. Donna asked Charlie to let her know once things are taken care of.

Speaker 1:

He further states that if you don't know who the person is, it's a much bigger problem. Charlie said if you do know who it is, it's very, very easy. Charlie tells Donna to stop getting worked up about things. Charlie assures Donna there's nothing she needs to worry about and that it is being looked into.

Speaker 2:

He's basically saying if you don't know who it is, they could keep fucking with you and fucking with you. Also, if you don't know who it is, it could be the police. If you do know who it is, and it's the police and you quit fucking with them. Or if you know who it is, you could kill them, as he stated earlier. That's what he was thinking, for sure, as he stated earlier, that's what he was thinking for sure. On April 29th, charlie tells Katie that he bought her husband Garcia a GoPro for his birthday.

Speaker 1:

And that's weird because Charlie he he don't even know Garcia's name, but he's buying him an expensive gift. That's weird.

Speaker 2:

Katie says Charlie should have givenrari he owns as a present. She mentions charlie's boat and charlie offers to quote unquote sell her his boat. And that refers to a previous conversation on april 15th when charlie offers to transfer the title for his 18 foot bay boat with 115 horsepower yamaha motor to her name. Kat Katie says she wants to get an Escalade. Charlie said they will work out future car situations. She's putting the pressure on this dude man. You know poor Charlie's pulling his fucking hair out. If you look at his arrest picture, his hair looks like a big old Afro on a white dude. It literally looks like he's grabbing his hair.

Speaker 1:

Einstein's hair. Freaking, pulling it out. That's what it looks like. Einstein's hair.

Speaker 2:

It that's what it looks like Einstein's hair it does. It looks like an Einstein except goofier. We'll also put pictures of him his arrest pictures on Patreon, so you can see what we're talking about.

Speaker 1:

Also I mean officers believe this is more evidence of Charlie wanting to keep her happy because he's like okay, we'll deal with this later. All right, whatever you want. And on May 4th 2016, at 2.09 in the morning, a text message was sent to Donna's cell phone from the undercover agent. Later in the day, charlie asked Donna if she is okay and Donna advises she will talk to Charlie about it on Sunday. Charlie wants to talk to Donna before Sunday and they agree to Charlie coming by around 11 30 am the following day on Cinco de Mayo. While driving to meet with Donna, Charlie calls Katie advising there has been a new problem and he may need to meet with her later on in the day on May 5th Cinco de Mayo, also Julie's birthday, charlie.

Speaker 2:

Charlie arrives at the Icon and they agree to meet at the pool area to discuss the text message. This time Harvey is present with Charlie and Donna as they huddle at the corner for privacy. They'd never gotten none of this conversation intercepted or captured. I guess they couldn't get close enough to him to hear it, or you know a recording device or anything. After this occurs, charlie leaves the icon and calls Katie asking her how someone would get his mother's number. Katie tells Charlie it's possible to locate the phone number online. Charlie starts talking about specific phrases sent to the through the text message.

Speaker 1:

Charlie then calls Donna and they discuss paying the $5,000. Charlie advised the sooner that they pay the money the better. They discuss being nice but firm when the money is paid, so that the person knows that this is only a one-time payment.

Speaker 2:

On Friday, may 6th, donna successfully contacted the agent by calling his phone number. The total duration of the call is 8 minutes and 48 seconds. The call was recorded by the FBI. In summary of the call, donna makes the excuse that her grandchildren had possession of her phone so she did not know that he had called. Donna goes over the previous contacts between herself and the agent. She says she is taking him seriously but she has stressed the fuck out. She claims that she has asked friends what she should do. She denies knowing anything about the murder referenced by the agent concerning help provided by her agent's friend Riviera. She then brings up the reward offer and suggests he seek that out instead.

He then brings up the reward offer and suggests he seek that out instead. The agent reminds her all he is asking for is $5,000. Donna claims she had nothing to do with the death of her ex-son-in-law. The agent reminds her that this is not going to go away and she does in fact know Katie and what was done for her. Donna continued to deny knowledge and ends the conversation by saying she will call the agent back.

Speaker 2:

About 11 o'clock that night Charlie called Donna and she gave him a disguised report on her call to the agent. Donna referred to the agent as a patient, indicated that she used a recording app for him to listen to the call. Donna says the call took about eight minutes. Charlie asked if the agent made any threats. Donna said no. He said hmm, that's very, very interesting. So they agreed to meet the following day.

Speaker 1:

Now, on May 7, 2016, charlie calls Katie and he's telling her about this new CD he wants her to listen to, indicating that he has a recording of the call between Donna and the agent. Charlie uses the reference pot belly pigs as the police, to which Katie responds. That's not good.

Speaker 2:

Pot belly pigs. I never heard them called pot-bellied pigs.

Speaker 1:

Now, about a week later, katie calls Charlie and she's complaining about her car, her Lexus, which was originally owned by Harvey Adelson, and Charlie's like oh well, you can use my Range Rover, and that's also titled in Harvey Adelson's name.

Speaker 2:

Well, Katie's got it going on. It's like she's got her foot on his neck and just pushing a little bit harder.

Speaker 1:

To get anything she wants, yeah and the cash and shit.

Speaker 2:

We'll talk about her finances here shortly, but it's unbelievable. Now Katie calls Charlie back complaining about the cost of fixing the car. Charlie tells her that he would pay for the repair himself or have the mechanic that fixed it the first time do it for free. Once again, anything Katie wants she's getting. Charlie returns the call to Katie from the previous call she complained about the Lexus not being repaired properly. She states she feels the welfare of her kids outweighs any monetary concerns she would have.

Speaker 1:

Now Charlie says everything is fine with the office. No more patients annoying him A reference to the agent because they're talking in code, not having any contact for over a week with the Adelsons. Katie asks well, I'm doing my job right. Will I get a raise soon, boy, she's always trying to milk him, ain't she?

Speaker 2:

She is. Troy says well, I'll look into the budget. By the way, thank you for going up there this weekend and straightening it up. I do appreciate that. Katie says oh, I was just cleaning it up. I'm still cleaning it up, though my job never ends.

Speaker 1:

The investigation indicated that Katie never went to or even worked at the Adelson Institute that previous weekend or ever.

Speaker 2:

So that the working and cleaning up was all basically their code word shit, as they thought you know what I mean. By this time, the police had it all figured out, though.

Speaker 1:

Yeah, they thought they were gangsters. They thought they were.

Speaker 2:

So the cops have everything tied together at this point. They have the handoff from the agent to Donna. They got Donna immediately calling Charlie and Charlie immediately calling Katie. So through all the wiretaps and the conversations that they listened to and all the trailing that they did, they pretty much had everything tied up together after they paid the $5,000.

Speaker 1:

Yeah, and so, on May 24th 2016, the police made contact with Sigfrido Garcia while he was at work. Simultaneously, contact was attempted with Katie at her residence.

Speaker 2:

Katie never came to the door and did not acknowledge the law enforcement's presence. Garcia spoke with agents at his business but denied having any knowledge about this investigation. Now, when the FBI were outside Katie's house, she was repeatedly trying to contact Garcia by making several calls and texting. She was blowing him up. This was exact same time when the agents were with Garcia. Garcia asked to speak with his attorney. That's all he said.

Speaker 1:

Yeah. So Katie's freaking out because she can't get a hold of him. He's not answering his phone, he's not replying to text messages. So she calls Garcia's work and Mike Perez answers the phone. Katie's like, hey, mike, where's Garcia at? Because someone's knocking on my door and I'm scared and she's whispering while she's talking to him. And Mike's like yeah, katie, the feds are here at work and they're with Garcia right now. And Mike asked Katie if she knows who's at her door and she responds saying that she does not know, maybe it's the police officers. And Mike's like well, I'll stop by and the call ends.

Speaker 2:

So he's gonna go over there and check katie calls mike back after receiving a text message and for him to call her, katie continues to whisper saying she is freaking out right now because they are knocking at the door. You know she is freaking the fuck out she, she's probably hid in the bathroom on her phone, whispering and shit.

Speaker 2:

Katie tells Mike she did not want them to know that she is home. He tells Katie that a male and a female FBI agent came by the office and is currently speaking with Garcia. Katie tells Mike the agents are in a white truck with black windows. Mike tells Katie that a vehicle is is undercover car and he recognizes it from the neighborhood. Mike said he's going to drive around the front and the back of her house.

Speaker 1:

Now how is he going to recognize this car from the neighborhood? It's an undercover FBI car.

Speaker 2:

Oh yeah, man, that's the undercover dudes. They're always hanging out in the hood. You know the undercover, the white one.

Speaker 1:

With the all blacked out one. So Katie calls Mike back after receiving another text message for her to call him. Mike tells Katie that it's the feds outside her house. He said they are parked three houses down on the same street. Mike told her the driver of the car is not inside. Katie asked if you were going to come inside the house and he responds saying they cannot without a warrant.

Speaker 2:

So Garcia called Katie back and tells her special agents came to talk to him. Katie asked Garcia what is going on and asked what they wanted to talk to him about. Now they got off the phone after that and later on Garcia called Katie back and he asked if the agents were still outside.

Now Garcia told Katie that he had spoken with an attorney, but the attorney said he couldn't help him with that shit, but he would have a friend contact him. They talked about it being embarrassing for the cops to go to Garcia's work and then Katie asked if they were allowed to sit outside her residence. Garcia asked Katie if they have $300 for attorney fees. Katie continues to be paranoid by making comments about the agents possibly jumping the fence into her backyard. You know she is tripping.

Speaker 1:

They're doing it all. So as soon as Garcia gets home from work, both of them immediately go to Walmart and they purchase two new cellular phones while still operating their previous cellular phones. But I bet they do that just for minimal time.

Speaker 2:

Well, you know it was minimal, because if they had any brains at all at this point, they've had to have figured out that they've been listening to everything or they wouldn't know anything, or you know unless, unless they're thinking, I wonder which one of the people in this investigation has fucking told on us. I wonder if they have any inkling at this point that it's the agent that give you know I mean the fake bullshit to get the money plus riviera.

Speaker 1:

I mean they had, they had their inklings, but they couldn't prove anything until they wiretapped them and started their little undercover sting. Because, rivera, he gave a proffer stating exactly what he did, but he just didn't know the connection. But they figured it out.

Riviera got a hell of a lighter sentence than the rest of the suspects in this case, because here at 69 South we got a little saying and it's called the one who squeals gets the better deals. And that's the truth. Now, after contact was attempted to both suspects, they quickly fled their house. On May 25th, two unknown subjects returned to the residence and gathered the family dog and several unknown objects.
